Halle Berry is contesting allegations raised by her ex-husband, Olivier Martinez, in Los Angeles Superior Court, after Martinez obtained a temporary domestic violence restraining order and sought sole legal and physical custody of their 12-year-old son.
Martinez alleged in court filings that Berry physically abused their son during a Sept. 26 incident. According to the Los Angeles Times, the filing alleged that Berry jumped on the child, put her hands around his neck and choked him. The allegations are claims in a family-court filing and have not been established as fact by a court.
A Los Angeles judge granted temporary restrictions on Thursday, Oct. 1. The Times reported that the order bars Berry from contact with Martinez and limits contact with their son to the terms set by the court, while denying Martinez's request for sobriety testing pending a further hearing. The next hearing is set for Oct. 16.
Berry's attorney, Marina Beck, called the filing "entirely meritless and deliberately misleading" in a statement reported by the Times. Martinez's attorney said the welfare and safety of the former couple's child remained paramount. The matter remains pending, and the temporary order is not a final finding on the allegations.
